quick poll...which presidential candidate will have the most asinine response to the ruling?

my moneys on santorum or huckabee.
The conservatives can blow it out their ass, the libertarians like me couldn't be happier.

my guesses were wrong. ted cruz is the first out of the gate with the insanity.

“I’ve introduced a constitutional amendment that would protect the authority of state legislatures to define marriage as the union of one man and one woman. We should pass that amendment,” Cruz told Hannity. “I’ve also introduced legislation stripping the federal courts of jurisdiction over legal assault on marriage.”

Cruz: Supreme Court rulings mean 'the darkest 24 hours' in history - Business Insider

darkest 24 hours...haha what a dick. im pretty sure there have been some harder times. civil war, pearl harbor, 9/11 are the first things i think of.
Horrible people like him would be better off in some other country. How clueless do you have to be to react this way? Truthfully, nobody really gives a shit one way or another, all these guys are just taking this stance for political positioning. And when that's over, just move on.

One more thing: what is the point of Antonin Scalia? He can be replaced with a 3 line computer program. A supreme court justice is supposed to be our country's top thinking mind, yet if you give me the next 50 upcoming cases, I can tell you how he'll vote on every one.

its cool to see this tonight.

well at least hes one of the joke candidates. bush had a much more appropriate response. while saying he disapproves he managed not to look like a complete wacko.

Jeb Bush Releases Statement: ‘I Believe in Traditional Marriage’ - The New York Times

“Guided by my faith, I believe in traditional marriage,” he wrote in a statement. “I believe the Supreme Court should have allowed the states to make this decision.”

But he also called for the country to “love our neighbor and respect others, including those making lifetime commitments."

Honestly I just don't get how you can be against gay marriage if you support freedom and equal rights. One of the reasons I left the GOP was the hypocrisy and the religious right drove me away. I'm big on freedom, live and let live, who am I to tell you how to live, do what makes you happy! As long as you don't infringe on others lives, do what you want.

Me neither, but I can see how someone can be for gay marriage but against the Supreme Court telling states they can't ban it. It's good to be cautious when it comes to the courts interpreting this sort of civil rights stuff.

Actual quote from Supreme Court justice Clarence Thomas in his dissenting opinion: "Slaves did not lose their dignity (any more than they lost their humanity) because the government allowed them to be enslaved."

Let's drive Clarence to a cotton field in southern Virginia ( a short drive down 95), dress him in rags, work him 18 hours a day in the sun, feed him slop, let him sleep on a bug-infested straw matress in a log building, sell his children, whip and rape his wife and daughters, beat him when he doesn't work hard enough, deny him any possessions or hope of a better life, much less his freedom, and then see how dignified he feels.

Stupid mother f*cker. Gentlemen, I give you Uncle Tom.

holy shit, that quote is stunning. i had to look it up after reading ur post and he goes on to include the japanese that were interned during ww2.

even though what the japanese and germans did with their concentration camps was a lot worse, it doesnt make what we did any better.

I've always wondered why all these decisions are not 9-0. It's legal in the law or not. How can one truly unbiasly interpret something and have a split decision? This means the Supreme Justices are allowing their belief to interpret the law something which should not be happening at their level.

I realize this is idealistic and will never actually happen.

I have two explanations:

First, the justices have different axioms about how the Constitution should be interpreted. Some are more strict, some more flexible.

My second explanation is much more cynical: Logic is our bitch. Humans are all driven by their base desires and instincts, and some are smart enough to use logic to hide it. The bedtt end up practicing law, and the best of those end up on the Supreme Court.

Not that I would ever do such a thing.

At the highest level, it's because humans are trying to capture reality inside of an imperfect construct--language, and by extension law--and then determine if events match up with the reality described by that construct. Laws are ambiguous, no matter how fine a point people try to put on them. Premeditated murder carries a higher penalty than a crime of passion. But what's premeditated? What constitutes meditated? How long prior to the act did the meditation have to take place? And that's a simple question. Interpreting the intent of the Constitution as to whether or not forbidding homosexuals to marry violates their rights is a harder one.

Plus, the Supreme Court is full of whackos like Scalia and Thomas, and flip-floppers like John Roberts. That doesn't help matters.

u make a lot of sense. however, id like more of the justices to be flip floppers. i really want to believe that the 9 justices are doing what they think is best for the country and not just playing party politics.

So you're saying that Scalia was intelligent enough to hide his bigotry via a brilliant display of logical superiority. Like how a serial killer might lure-in and befriend their victims.

Not just Scalia, but all of them. They all make decisions based on what feels "right" and try to sculpt arguments to justify those decisions.

I did the same, I read interpretations of his dissent from several different sources, because (on it's surface) it seems unbelievable that anyone - let alone a black SCJ - would say this.

Here's what I came up with. The part of his dissent that preceded the quote above is the key. He's asserting that "dignity" is not given to a person by government, and therefore it cannot be taken away by government. In other words, "dignity" comes from within a person, so it is independent of law.

The problem is, I couldn't disagree with this more. The definition of "dignity" is:
- bearing, conduct, or speech indicative of self-respect;
- nobility or elevation of character; worthiness:
- elevated rank or relative standing; rank.
All of these are denied when one's rights and freedoms are denied. So in conclusion, Thomas is really a f'n asshole.

This is turning into a thread bashing Supreme Court justices of a certain political view.
It's always dangerous to express political opinions when one isn't allowed to discuss politics. It's something we all naturally do without thinking.

Did a post mysteriously disappear? Anyway, in the spirit of being fair and non-political, let me try to clarify the thoughts posted here.

Thomas's statement was just bizarre, doesn't matter which side he's on. And Scalia's childishly mocking words are equally inappropriate, and not befitting a person of his position. But other than that, these 2 shouldn't be singled-out for consistently voting a particular way, because there's another group of justices that consistently vote the other way. Seems to defeat the purpose of "judging".
