The penalty for leaving the scene is less than DUI. The guy will go home sober up and cop to leaving the scene. Usually that is what happens. Unless he figures he can get away with it.

On December 23, police shot at an assault suspect in a Burlington store in North Hollywood. A bullet pierced a dressing room wall and killed a 14-year-old girl. Video has been released. Officers are taught, "Make sure you go home tonight." In other words, don't let yourself get shot. Here's a novel idea for the police: Make sure everybody gets to go home.
