Ex-Cake Drummer Accused of Molesting Child May Be Retried After Mistrial

Peter Ivan McNeal, the former drummer for the band Cake, could be headed back to court in a retrial for charges he molested a 3-year-old girl in a Laurel Canyon home during a 2009 Thanksgiving dinner.

Monday, a judge declared a mistrial in McNeal's case, after the jury reported they were deadlocked at an 11-1 decision in favor of the musician's guilt, according to City News Service.

The incident in question took place at a home where McNeal, 46, was a guest on November 26, 2009. The victim, visiting with her parents from Massachusetts, was one of several children in attendance at the gathering, and trial testimony indicates she participated in a ball game with McNeal during the festivities.

However, the child blurted out a disturbing question after the dinner party to her parents: "Why did that man want to put his penis in my mouth?'' the victim's mother testified her daughter queried. The mother also noted that the daughter specified it was the man she was playing ball with.

The victim's mother also testified that later that evening in the bath, she asked her daughter to show her what happened with the man. The mother said the girl took a metal Thermos bottle, held it to her crotch and "pushed it in my mouth'' while moving her hips.

The family opted to file a claim in Massachusetts two years later, when their daughter brought up the incident again. The victim's parents said they waited in order to be completely certain about the allegations before pursuing a case against McNeal.

McNeal, a father of two who has worked as a drummer, percussionist and vocalist with artists including Norah Jones and Mike Doughty, was arrested in January. He was charged with one felony count of oral copulation and sexual penetration of a child under the age of 10. McNeal was the drummer for Cake during 2001-2004, replacing drummer Todd Roper, who appeared on their 2001 album "Comfort Eagle."

During the trial, the prosecutor also introduced evidence that McNeal was convicted on a misdemeanor charge of attempting to molest a 6-year-old girl just two weeks after that Thanksgiving while the drummer volunteered at a Los Angeles school. He was sentenced to three years' probation.



Which raises the question... is "oral copulation" and sexual penetration of a 10 year old not a felony?? His charge includes the wording "a child under the age of 10" It certainly should be a felony!

It says it is a felony in the wording. What leads you to think it is not? His previous conviction was a misdemeanor.
 
The wording is "a child UNDER the age of 10" is a felony, which makes me wonder what the charge is for 10 to whatever upper age limit.
 
Don't have a moderator here. If there were one, it'd be me.

Some of the emails that have come through here (mainly the executives, go fig) would not only set off the content filter, but would set off the fire alarm and have authorities rappelling down the side of the building and smashing through windows.

But moderating the content would be useless here anyway. We have the word 'cum' in the friggin' company name!! I've seen many times, mainly in the past, where a customer or vendor didn't get our email and it was because their 'spam trigger word' settings blocked our company name.

The musicians and journalists who formed Fowley’s inner circle back then wanted to see his menace as an act, a test to weed out the weak. But some of his behavior was simply too violent to dismiss. In September 1975, Audrey Pavia, who had just turned 18, ended up backstage at an early Runaways show, when the band was just a trio. Without warning, Fowley ran at her from across the room.

“He threw me up against the wall and he put his arm across my neck,” Pavia remembers. “Then he hammered his knee between my legs.” Fowley lifted her up off the ground and licked her face. He bit and sucked on her ear. She says she struggled to get away, but he pinned her to the wall for five minutes, telling her all the things he was going to do to her.

“I was terrified. I was embarrassed,” Pavia says. “This is the part that’s most embarrassing for me. … I was a virgin. This was the most physical contact I’d had with a man.” Afterward, she noticed that her hair was matted with his spit.

Once everyone went to sleep, Krome says, Fowley walked into the living room and shook her awake. Before she could make a sound, he put a finger to his lips, shushing her. Then he grabbed her by her ankle and pulled her into the bedroom.

When Krome asked what was going on, he said something like, “It’s time for dog worship” and told her if she didn’t give in to his sexual demands, she’d have to go back to Long Beach. Krome thought about leaving, calling someone for a ride. But her family was poor and didn’t have a telephone. She had nowhere to go. That night, Fowley masturbated on her.

“I didn’t know how to say, ‘I don’t want you to do this,’” Krome says. “I did not have that voice. … I was also scared of him. He could be really scary.”

Fowley sexually assaulted her several other times, Krome says. “In his mind, he thought he was having a relationship with me, like a romantic relationship,” she says. “He didn’t care what I thought about it. He just decided.”

Krome was 14.

Soon after Jackie arrived at the motel, a grown man she thinks was a roadie approached her with a Quaalude in his hand. He told her she needed to take it, no questions asked. And she did. Another partygoer, Brent Williams, a friend of Krome’s, says he heard people (not members of the band) talking about the number of Quaaludes Jackie was being given that night—four, five, even six pills.

According to Roessler, Fowley stood over Jackie and began to unbutton her blouse. Jackie wasn’t wearing a bra. “Nobody seemed to really care,” Roessler says. “It was really weird. Everybody was sitting in there alone with themselves. It felt like everyone was detached or trying to pretend like nothing was going on.”
When Fowley started taking Jackie’s pants off, Roessler couldn’t bear it anymore. She got in her parents’ car and left. Around this time, Williams stumbled into the room. Multiple witnesses say that Fowley began to penetrate Jackie with the handle of a hairbrush. “It was one of those times you feel like there’s a spotlight on you,” Williams says. “Everybody’s looking at you to see how you would respond. You just want to get out of there.” And, soon enough, he did.

Fowley invited other guys to have sex with Jackie before removing his own pants and climbing on top of her. “Kim’s fucking someone!” a voice shouted from the door of the motel room to the partygoers outside, calling them in to watch. Arguelles returned to the room to see if this was all a big joke. On the bed, Fowley played to the crowd, gnashing his teeth and growling like a dog as he raped Jackie. He got up at one point to strut around the room before returning to Jackie’s body.

“It turned into this really disgusting Grand Guignol–like theater performance that he put on,” Krome says. “And Jackie was dead, dead, dead drunk—like corpse drunk. She was just laying down on her back, sound asleep, out of it.” Krome says Fowley picked up Jackie’s arm “and it flopped down like a marionette. … He had to manually move her body parts into positions that he wanted for himself.”

Victory Tischler-Blue was Jackie’s replacement on bass, and one of her main memories from her time as a Runaway was how some of the other members made fun of what happened to Jackie. “I heard about that nonstop,” she says now. “They would talk about Kim fucking Jackie like a dog. It was kind of a running joke.”

R. Kelly Is Convicted of All Counts After Decades of Abuse

R. Kelly, the multiplatinum R&B artist whose musical legacy became intertwined with dozens of accusations of sexual abuse, was found guilty on Monday of serving as the ringleader of a decades-long scheme to recruit women and underage girls for sex.

The jury in New York deliberated for about nine hours before convicting the singer of all nine counts against him, including racketeering and eight violations of an anti-sex trafficking law known as the Mann Act.

Throughout the proceedings, the result of Mr. Kelly’s only other criminal trial, in 2008, stood in mind for many observers. Prosecutors in Chicago had argued that a videotape showed him having sex with and urinating on an underage girl. But he was acquitted of all 14 counts against him after the girl at the center of the case declined to testify.

It featured an enormous pile of evidence, including text messages that showed the real-time worries that some of Mr. Kelly’s employees shared about his treatment of women and several video and audio recordings, some of which appeared to depict the singer violently assaulting a woman and threatening her life.

Decades before the trial began, Mr. Kelly’s marriage to Aaliyah in 1994, when she was 15 and he was 27, was among the first revelations to bring substantial public scrutiny to his encounters with underage girls.

One of Mr. Kelly’s former tour managers confirmed a long-rumored tale that he bribed a government employee to get a fake identification for Aaliyah so the wedding could go forward, because Mr. Kelly feared that she was pregnant and that he could be prosecuted for statutory rape.

And a cascade of witnesses described a repressive system of restrictions that the women and girls around Mr. Kelly were forced to abide by — from a directive to address him as “Daddy” to requirements to obtain his permission to eat or use the bathroom.

They said that when the rules were broken, the singer doled out harsh and startling punishments, from skin-tearing spankings to forcing one woman to smear feces on her face and eat it.

R. Kelly Sexually Abused Aaliyah When She Was 13 or 14, Witness Says

Angela said she first met Mr. Kelly around 1991, when she was between 14 and 15 years old. The singer began to have sex with her while she was underage and a student in high school, she testified.

The witness, a former backup performer, said she walked in on the singers as they were engaged in a sex act around 1993, one year before they were illegally married.

On a separate stop in Washington, D.C., during the tour, Angela recalled that she and a group of other girls including Aaliyah were reprimanded for breaking the singer’s instructions. Angela told jurors that they had made a trip to a 7-Eleven convenience store for food, but that Mr. Kelly had told them not to leave their hotel. When he learned of their disobedience, he demanded sex, she said.

“Robert told all of us we would have to put out,” she said. “It was dues time,” she added, explaining to jurors that the singer often presented having sex with him as a form of paying their dues.

Also on Monday, a second male accuser testified against Mr. Kelly. The witness, identified only as Alex, said Mr. Kelly groomed him for sex beginning when he was 16. He said that they began having sex when he was 20, and said that from 2007 to 2019 he was “brainwashed” by the singer.

Mr. Kelly first made an advance on him inside the singer’s Maybach, when Alex was about 20 years old, he said. “I recall him just talking to me, then forcefully kissing me, licking my face,” he said, adding that afterward Mr. Kelly told him “just to be open-minded.”

On one occasion, he said Mr. Kelly told him he had a gift for him, and instructed him to wait in a room Alex said he believed was the bedroom of one of the singer’s children. There, Mr. Kelly had set up an iPad and production lights, and directed Alex to take off his clothes. Then, the singer “sent the half-naked lady into the room.”

“He pretty much told us to go at it, but we didn’t know what to do because he was still in the room,” he said, adding that the singer then “told us to start kissing each other — and to mean it.”

Mr. Kelly began recording, Alex said, and then masturbating as he directed them through a series of sex acts.

During the encounters, the women — whose names he did not know — appeared “zombie-ish,” he said.

Jerry Lee Lewis was known as the Killer, and it wasn’t a casual sobriquet [nickname] — a schoolmate called him that after he tried to strangle a teacher. He once shot his bass player in the chest; just about all of his seven wives, including one who was a child, said he beat them; and there’s a lingering suspicion that he murdered wife No. 5.

Lewis married in 1952, at the age of 16 — properly, in a ceremony at his rich uncle’s house. The bride was a 17-year-old preacher’s daughter named Dorothy Barton. Lewis rued the union on the morning after the wedding night. He didn’t pay much attention to his wife moving forward.

The tale of the marriage to his second wife, Jane Mitcham, is somewhat murky; in one telling he’d met her in Natchez in between his spells at a local whorehouse. Mitcham got pregnant, and their wedding happened after her brothers tracked Lewis down in his hometown — never mind that he was not divorced from Dorothy. This was during his ascent to stardom, and he paid even less attention to Mitcham than he had to his first wife, even after the birth of their son, Jerry Lee Jr. It was an acrimonious four-year marriage; Jane Lewis once knocked out every one of the windows in his car. A second child, named Ronnie Guy, Lewis refused to acknowledge.

While living at his cousin JW Brown’s house, Lewis, then 21, grew close to the family’s 12-year-old daughter, Myra Gale. The pair spent increasing amounts of time together and, in Lewis’s own telling, after an evening spent messing around in his car, he resolved to marry her. By this time, Myra had turned 13.

In 1976, drunk, he drove to Graceland, Elvis Presley’s mansion, and rammed the gate with his Lincoln; he emerged from the car half-dressed and bleeding, brandishing a gun. “You tell him the Killer is here,” Lewis told the guards. Presley told his guards to call the police, and Lewis was arrested. That same year, drunk on his 41st birthday, he was playing around with a .357 revolver and shot his bass player in the chest.

His marriage to Myra staggered along for another eight years, each bleaker than the next, as she contended with his atavistic views of women (she wasn’t allowed to cut her hair or dress up), drug use, and ongoing infidelities. They divorced in 1970. By the end of 1971 he had married again, for the fourth time, to a woman named Jaren Gunn Pate; she moved out within the month. She had a child, Lori Leigh Lewis, but again Lewis insisted he was not the father. He and Pate never lived together but were married for nearly a decade, a non-alliance punctuated periodically with child-support suits. She was found dead in a swimming pool in June 1982.

Wife No. 5 was Shawn Michelle Lewis, whom he married in 1983. She was found dead in Lewis’s house after 77 days of marriage. Her death was examined by investigative reporter Richard Ben Cramer in a very long Rolling Stone story the next year. In Cramer’s telling, the marriage included episodes of violence, alternating with Lewis’s fixation on having Shawn participate in a threesome with her sister. What exactly happened the night of her death remains a mystery, but all sorts of evidence — including the blood and broken glass in the house and the fact that the body had been moved after she died — suggests that the full story has not been told.

A year later he married wife No. 6, Kerrie McCarver, who ended up nursing him through a succession of severe illnesses, including infections in his thigh — he’d been using needles to inject speed into his system in his leg — and a ruptured stomach that nearly killed him. They had a child, Jerry Lee Lewis III, in 1987, then separated but stayed married for another 17 years.

That's the kind of groupie story made famous by the movie Almost Famous.

It's been several decades since I've had to pay attention to the specifics of the dating laws, but in Ohio (if I remember it correctly) there's a law that says a 16 year old can date someone 5 years older if the parents consent. Granted, this is 9 years, but it seems like the parents were in on it.

If it was my daughter, I'd have strung him up by his toys in the basement, if ya know what I mean.
