Last week I caught the last part of Howard doing a bit with an actor impersonating Melania Trump. It was funny. Isn't that the kind of thing that will earn The Donald's eternal wrath against Howard? I'm impressed. Go Howard.
 
Heard the whole thing. Thought this bit might ruffle The Donald.

Howard is on the phone with the Melania character:

Howard: Not a good idea for Donald to attack a Gold Star Family.

Melania character: In my country we put gold stars on Jews. We also put bells on their feet so they cannot sneak up on you.
 
This is now somewhat newsworthy, as (real) Melania is talking about suing a bunch of media outlets over talk of her as an escort. Guess when her and Donald have sex, his tremendously thin skin rubs-off on her. So people can say that Hillary absolutely murdered various people, absolutely committed crimes, and is a sexless lesbian, and that's ok, because she's a public figure, just like Melania.

As for Howard, I'm happy to see he's joining the rest of the world, and making jokes/ observations/ criticisms about both presidential candidates. I mean, what the hell does he have to be afraid of?

yes she is a public figure and yes presidents and first ladies usually dont act on slanderous claims but that doesnt mean they can't. if fox news runs a story that hillary is a murderer thats slander and she can sue if she chooses. she doesn't cause thats just not how its done but she could. same goes for outlets saying mealina was an escort. if its not true its clearly slander.
 
An asshole businessman in New Hampshire, who has been found guilty of corruption multiple times, has an electronic sign on his business property. It falsely claims that various public figures are murderers, drug dealers, and convicts. It's been up for 2 years. It cannot legally be stopped, it's a 1st amendment right. Trump is a hypocritical idiot. He has sued or threatened to sue thousands of times, to no avail. It's all about publicity.

The hypocrisy is that he supposedly represents our 1st amendment freedom to speak our mind, and not be politically correct. But this freedom apparently doesn't apply to anyone else, because his infantile brain doesn't understand that everyone has the same rights as him.
 
If I recall, a public figure can sue for libel if the libeler knew or should have known there was no basis for the publication and if his, her or its actions evince malicious intent.

i dont know the ins and outs of the law but neigh sounds right to me.

there we go. there are times when people responsible for the slander are considered such outliers that its not worth the time and money to sue. but the subject of the billboards can have his day in court if he wants. that dude cant just put those billboards up accusing someone of illegal actions and call it protected speech.

so yea i think obama could sue trump for saying he started isis. that seems to me like pretty clear slander. obama wont sue because although its not a written rule, presidents lose their rights to pursue slander. but trump/melaina dont adhere to the unwritten rules (like with his taxes) so although weird its still within her rights to sue if someone or some organization publicly comes out calling her a former whore.
 
Slander is for the spoken word. Libel is for the written word.

There is also a standard of, "would a reasonable person believe they claim as presented." If you remember in the case that formed the third act in the movie, "The People vs. Larry Flynt," the ad in question was so ridiculous it was clearly humorous parody, hence no libel there.
